UK GDPR Representative Services: Your Questions Answered
Who needs to appoint a UK GDPR representative?
Any controller or processor with no establishment in the UK that either offers goods or services to people in the UK or monitors the behaviour of people in the UK. It applies regardless of your size or sector and regardless of which country you are based in. There are narrow exemptions, including public authorities and occasional low risk processing that involves no special category or criminal offence data on any significant scale.
Is a UK representative the same as an EU representative?
No, and since Brexit one does not cover the other. If you target individuals in both the UK and the EU, you need a UK representative under Article 27 of the UK GDPR and an EU representative under Article 27 of the EU GDPR. They are separate appointments with separate published contact details.
Is a UK representative the same as a Data Protection Officer?
No. A representative is a local contact point for individuals and the ICO. A DPO is an independent advisory and monitoring role with statutory duties and protections under Articles 37 to 39. One organisation can require both, and the same provider can supply both, but they are distinct services with distinct obligations.
Does appointing a representative make our data transfers lawful?
No, these are two separate obligations that are often confused. Appointing a representative satisfies Article 27. Getting personal data lawfully from the UK to you is a Chapter V transfer question, answered by adequacy, an International Data Transfer Agreement or the UK Addendum with a Transfer Risk Assessment, depending on your country.
Which countries have UK adequacy?
The UK currently recognises Andorra, Argentina, the Faroe Islands, Gibraltar, Guernsey, the Isle of Man, Israel, Jersey, New Zealand, Switzerland and Uruguay, plus Japan with exceptions, South Korea, and the US where the importer is certified under the UK Extension to the EU-US Data Privacy Framework. Australia and the Gulf states are not on the list, so transfers there need an IDTA or the UK Addendum together with a Transfer Risk Assessment.
Can we just use our UK law firm or our UK distributor instead?
Only if they are formally designated in writing as your representative, are genuinely reachable by individuals and the ICO, and are prepared to hold a copy of your record of processing activities. Most distributors and many law firms will not accept the mandate once they understand what it involves, which is why the appointment needs to be explicit rather than assumed.
Do we have to publish our representative's details?
Yes. The designation is only effective if individuals can find it, so the representative’s name and contact details must be given in your privacy notice and made easily accessible to people in the UK, alongside the usual Article 13 and 14 information.
